Capek Law, P.C. respects the privacy of everyone who visits this website, contacts our office, or entrusts us with a legal matter. This policy explains what information we collect, why we collect it, how we use and protect it, and the choices you have.
Last updated: September 20, 2026
Scope of This Policy
This policy applies to information collected through this website and through the ordinary channels people use to reach our office — contact forms, email, telephone, and text message. It also describes, in general terms, how we handle the personal information of prospective and current clients.
It does not apply to third-party websites we link to, to platforms that host our reviews or profiles, or to information governed by a separate written agreement with our firm. Where our professional obligations as attorneys impose stricter duties than this policy describes, those obligations control.
Information We Collect
Information you give us. Your name, telephone number, email address, mailing address, and whatever you choose to tell us about your situation when you submit a form, call, email, or text. If we open a matter for you, we collect the additional information needed to represent you, which may include records from medical providers, employers, insurers, courts, and law enforcement.
Information collected automatically. When you visit this website, our hosting and analytics providers may record your IP address, approximate location, browser and device type, operating system, referring page, the pages you view, and the dates and times of your visits.
Information from other sources. We may receive information about you from co-counsel, referral sources, opposing parties, courts, public records, and service providers, in each case as needed to evaluate or handle a matter.
Cookies & Similar Technologies
This website uses cookies and similar technologies to keep the site working correctly, remember your preferences, measure traffic, and understand which pages are useful. Some are strictly necessary; others are used for analytics or advertising measurement.
Most browsers let you refuse or delete cookies through their settings. Blocking cookies may affect how parts of this website function. Where required, we honor browser-level opt-out signals such as Global Privacy Control.
How We Use Information
We use the information we collect to respond to inquiries; to evaluate whether we can take on a matter and check for conflicts of interest; to provide legal services to clients; to communicate about matters, appointments, and case status; to operate, secure, and improve this website; to send information about our services where permitted; and to comply with legal, regulatory, and professional obligations.
We do not use the content of client communications for advertising, and we do not sell personal information.
Confidentiality & Privilege
Submitting a form, sending an email, or leaving a voicemail does not create an attorney–client relationship, and information you send before a relationship is established in writing may not be protected by the attorney–client privilege.
For that reason, please share only what is needed to identify you and describe the general nature of your matter until we confirm we can represent you. Once you become a client, your information is protected by the attorney–client privilege and by our duty of confidentiality under the applicable rules of professional conduct, which are broader than this policy.
How We Share Information
We share personal information only as needed, and only with parties who are obligated to protect it. That may include service providers who host our website, manage our email and case files, transcribe calls, or process payments; co-counsel, experts, investigators, and vendors retained in connection with a matter; and courts, opposing counsel, and other parties where disclosure is required to advance or resolve a client's case.
We may also disclose information when required by law, subpoena, or court order, to protect the rights and safety of our firm, our clients, or others, or in connection with a merger or reorganization of the practice. We do not sell personal information and we do not share it for cross-context behavioral advertising.
Calls, Email & Text Messages
If you give us a telephone number or email address, you consent to receive responsive communications from our firm at that number or address, including calls, text messages, and email. Message and data rates may apply, and message frequency varies.
You may opt out of text messages at any time by replying STOP, and you may unsubscribe from marketing email using the link in any such message. Opting out of marketing does not stop communications about an active matter. Calls to and from our office may be recorded or monitored where permitted by law.
Analytics & Advertising
We use analytics services to understand how visitors find and use this website. These services set their own cookies and may collect IP addresses and usage data under their own privacy policies. We may also use advertising platforms to measure the performance of campaigns that bring people to this site.
We do not use these tools to identify individual visitors by name, and we do not combine advertising data with the contents of client files. You can generally opt out of analytics and interest-based advertising through the settings offered by those providers and by your browser.
Data Retention
We keep website inquiry information only as long as needed to respond and to document conflicts checks. Client files are retained for the period required by our professional obligations, applicable law, and our file retention policy, after which they are destroyed securely.
Technical logs and analytics data are retained for a limited period under the terms of the relevant provider.
Data Security
We use administrative, technical, and physical safeguards intended to protect information against loss, misuse, and unauthorized access, including encrypted transmission on this website and access controls on our systems.
No method of transmission or storage is completely secure, and email and text messages in particular can be intercepted or misdirected. Please do not send sensitive documents by email until we have confirmed a secure method with you.
Your Choices & Rights
You may ask us to confirm what personal information we hold about you, correct it if it is inaccurate, or delete it; you may withdraw consent to marketing communications; and you may ask us to stop contacting you by a particular method. To make a request, use the contact details at the bottom of this page.
We will verify your identity before acting on a request. Some information cannot be deleted — for example, records we are required to retain under our professional obligations, conflict-of-interest records, and information needed for an active or concluded matter.
State Privacy Rights
Residents of certain states have specific rights regarding their personal information, which may include the right to access, correct, delete, or obtain a portable copy of it, the right to opt out of targeted advertising or the sale of personal data, and the right not to be discriminated against for exercising those rights.
We honor these rights for residents of any state whose law provides them, without regard to whether that law technically applies to our firm. If we deny a request, we will explain why and how to appeal.
We Do Not Sell Your Information
Capek Law, P.C. does not sell, rent, or trade personal information, and we do not share it with third parties for their own marketing purposes.
Information you provide to this firm is used to answer your question, evaluate your matter, or represent you — nothing else.
Children's Privacy
This website is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children through this website.
Where a matter involves a minor client, information about that child is collected from a parent or guardian and handled under the same confidentiality obligations that govern every client file. If you believe a child has provided information through this website, please contact us and we will delete it.
Third-Party Sites & Services
This website links to third-party websites, review platforms, and social media profiles. We do not control those services and are not responsible for their content, security, or privacy practices.
Anything you post publicly on a review platform or social media — including details about a legal matter — is outside our control and may be visible to anyone. Please be careful about what you share publicly while a matter is pending.
Accessibility
We work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA so that this website, including this policy, is usable by as many people as possible.
If you need this policy in an alternative format, or encounter a barrier anywhere on this website, contact us and we will provide the information in a form you can use.
Visitors Outside the United States
This website is operated in the United States and is directed to people located in the United States. If you access it from elsewhere, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.
By using this website or contacting our office, you understand that your information will be handled as described in this policy.
Changes to This Policy
We may update this policy as our practices, our technology, or the law changes. The version posted on this page is the version in effect, and the date at the top indicates when it was last revised.
Material changes will be reflected here; your continued use of this website after a revision is posted constitutes acceptance of the updated policy.
